Hello dear translators,
I would be very grateful if any one of you could tell me the nuance between "Jurisprudence" in French and "Jurisprudence" in English.
The two terms had originally the same meaning (the science or philosophy of law). This meaning, which is still kept in English, has become very rare in French and the word "Jurisprudence" is used today to mean the orders and judgements delivered by a given court in a given case (الاجتهاد القضائي).
For this meaning, I found as an equivalent the British "Case Law" and the American "Common Law".
The English meaning, which "Jurisprudence" does not have, is "a system of laws or a particular branch of law".
My question is: is there any case where the French "Jusrisprudence" can be translated as "Jurisprudence" in English?
Can the English word be an equivalent of the Arabic term "الفقه", taking into consideration the second definition?
